SPECIAL MEETING NOVEMBER 7, 2007 1. CALL TO ORDER: Mayor Pro-tem Connie Castro called the special
meeting of the City of Hilshire Village to order at 6:32 P M at 8301 Westview,
Houston, Texas. Present were
Council members Brian Henault, Zandra Anderson, John Denninger and Shannon
Whiting. Mayor Robin S. Border was absent. 2. CITIZENS COMMENTS: David McDuffie (1335 Friarcreek) was concerned about the tree trimming. He said Òresidents have rightsÓ in regard to who has access to their property. 3. DISCUSSION AND POSSIBLE
ACTION: 3.1. AN ORDINANCE PROVIDING FOR THE LEVY
AND COLLECTION OF AD VALOREM TAXES OF THE CITY OF HILSHIRE VILLAGE, TEXAS, FOR
THE YEAR 2007; PROVIDING FOR TWO COMPONENTS TO THE PROPOSED TAX RATE, which SHALL BE APPROVED BY SEPARATE MOTION;
PROVIDING FOR THE DATE ON WHICH SUCH TAXES SHALL BE DUE AND PAYABLE; PROVIDING
FOR PENALTY AND INTEREST ON ALL TAXES NOT TIMELY PAID; REPEALING ALL ORDINANCES
OR PARTS OF ORDINANCES INCONSISTENT OR IN CONFLICT HEREWITH; AND PROVIDING FOR
SEVERABILITY, CONSISTING OF: A. TAX RATE OF $0.141770 Cents for the purpose of paying the
accruing interest and to provide a sinking fund for payment of the indebtedness
of the City, b. tax
rate of $0.378029 Cents for the purpose of funding the maintenance and operation expenditures Note: At the October 30, 2007 special meeting the total tax rate of 0.519799/$100 was passed but the ordinance had not been presented at that time, so this is formal presentation of ordinance. It was moved by
Whiting, seconded by Henault that Section A. tax rate of $0.141770/$100 for paying off the accruing interest and to provide
a sinking fund for payment of the indebtedness be approved, and motion
carried 4-1 with Anderson opposed. Section 3.1. (b) Continued: Council member Anderson made a motion
that Section B tax rate of $0.378029/$100 be approved for the purpose of funding the maintenance and operation
expenditures.This motion was seconded by Denninger, and motion
carried unanimously. 3.2. Consideration and possible action on allowing Centerpoint Energy to continue tree work in the utility right-of-way under CenterpointÕs current practices. (Anderson): Anderson had previously furnished Council at the last meeting with brochures from Centerpoint regarding their tree-trimming practices. Today she met with Mr. Sbrusch of Centerpoint to review their practices. Anderson furnished Council with a memorandum and a sketch of the cutting guidelines as well as a map of Hilshire Village with the utility easements marked. Sbrusch said before trimming began they reviewed the plats of the City. He also provided Council with outages listed for the entire circuit, which constituted 1529 customers located in Houston, Spring Valley and Hilshire Village. CenterpointÕs practice is to have unobstructed aerial easement of 20 feet, with a five-foot adjacent easement above the aerial easement. They do not say which ÒsideÓ. They want seven feet from the cross arm at the top, which totals 20 feet in width. In addition, they want to clear 15 feet below the primary lines and 80 feet above the primary lines. Anderson said Òthis large pattern is hard to believeÓ. No trimming is to be outside
of the easement. The issue is the width of the cuts and the method of cutting. The easement wording on the Ridgeley Place and
Burkhardt Plaza plats could be interpreted differently. After some discussion,
it was decided that Anderson and DellÕOsso should review the wordings and
report back to Council. (DellÕOsso had been unable to meet with Anderson prior
to this meeting.) It was moved by Denninger that this item be tabled, and
motion carried 4-1, with Henault opposed. Motion to table carried
